With respect to travel services confirmed and booked through The Good Traveler Colombia, liability shall be governed by Section 9 (Our Role as Tour Operator) and by the Colombian Consumer Statute (Ley 1480 de 2011). To the maximum extent permitted by applicable law, the Company’s aggregate liability for any claim arising from a confirmed booking shall not exceed the total amount paid by the Traveler for the affected services. The Company shall not be liable for indirect, incidental, special, consequential, or punitive damages.
8. Travel Services
The terms governing actual travel bookings, cancellations, refunds, and travel services are set forth in our Cancellation & Booking Policy. These Terms & Conditions govern only your use of this website and the contractual framework applicable to bookings confirmed with The Good Traveler Colombia.
9. Our Role as Tour Operator and Provider Responsibility
The Good Traveler Colombia acts as the tour operator of the experiences and travel packages offered through this website. The Company designs, coordinates, and stands behind the travel services contracted by the Traveler, including those services rendered by independent partners such as hotels, transportation companies, guides, restaurants, and activity providers.
The Company carefully selects and verifies its partners. Such partners are independent business entities responsible for the direct execution of their respective services. The Company assumes responsibility before the Traveler for the proper coordination and quality standards of the package sold, and expressly reserves its right of recourse (acción de repetición) against the responsible partner where compensation must be paid to the Traveler for failures attributable to such partner.
The Company shall not be responsible for: (a) circumstances beyond its reasonable control as set forth in the Force Majeure clause; (b) decisions made by the Traveler or by third parties acting on the Traveler’s behalf that contradict the recommendations issued by the Company or its partners; (c) damages caused by the Traveler’s non-compliance with the safety instructions of the operator or with applicable local laws; or (d) loss, theft, or damage of personal belongings outside of the Company’s direct custody.
10. Eligibility and Minimum Age
The Traveler must be at least eighteen (18) years of age in order to enter into a booking with The Good Traveler Colombia. By submitting a booking request, the Traveler confirms holding the legal capacity to enter into a binding agreement and that the information provided is true and accurate.
Minors under the age of eighteen (18) may travel with The Good Traveler Colombia provided they are accompanied by a parent, legal guardian, or duly authorized adult who shall hold the booking and shall assume full responsibility for the minor throughout the experience. Certain activities (including, by way of example, multi-day treks, white-water rafting, scuba diving, or experiences involving the regulated consumption of alcoholic beverages) may carry additional minimum-age requirements established by the relevant operator, which shall be communicated prior to booking confirmation.
In the event of international travel to Colombia involving minors who are Colombian nationals or residents, Colombian immigration authorities may require additional documentation pursuant to Ley 1098 de 2006 (Código de la Infancia y la Adolescencia). Compliance with such requirements shall be the sole responsibility of the Traveler.
11. Payments, Invoicing and Refunds
Bookings shall be confirmed exclusively upon receipt by The Good Traveler Colombia of the initial payment established in the Cancellation and Booking Policy. Payments shall be processed solely through the online payment gateway available on this website, which accepts credit and debit cards. Charges are billed in Colombian Pesos (COP); any currency-conversion fee applied by the issuing bank of the cardholder shall be borne by the Traveler.
The Good Traveler Colombia shall issue electronic invoices (factura electrónica DIAN) for services rendered in Colombia, in accordance with applicable Colombian tax regulations. International travelers may qualify for VAT (IVA) exemption on tourism services rendered in Colombia pursuant to Article 481 of the Colombian Tax Statute, subject to presentation of a valid passport and proof of foreign residency.
Refunds, where applicable under the Cancellation and Booking Policy, shall be processed through the same payment method used in the original transaction within fifteen (15) business days following the date the refund is approved. Bank fees and currency- conversion charges imposed by the cardholder’s financial institution shall not be refunded. In the event of partial cancellation (one or more travelers within a group booking), the Cancellation and Booking Policy shall apply proportionally to each cancelled spot.
12. Mandatory Travel Insurance
All international travelers shall hold valid travel insurance covering, at a minimum:
- Medical emergencies and hospitalization in Colombia
- Medical evacuation and repatriation
- Personal liability
- Trip cancellation and interruption
For domestic travelers, and for any traveler participating in destinations or activities involving elevated risk (including, without limitation, Chocó Pacific, Los Llanos, the Ciudad Perdida trek, multi-day expeditions, white-water rafting, paragliding, scuba diving, or high-altitude experiences), travel insurance with adventure-sports coverage shall be mandatory regardless of nationality.
It shall be the Traveler’s responsibility to obtain such insurance and to provide The Good Traveler Colombia with proof of coverage prior to the commencement of the trip. The Company shall not be liable for medical, evacuation, or any other costs incurred by uninsured travelers.
13. Force Majeure
Neither The Good Traveler Colombia nor its partners shall be held liable for the failure to perform, or for delays in the performance of, their obligations when such failure or delay is caused by events beyond their reasonable control. Such events include, without limitation: natural disasters, severe weather conditions, road closures, geological events, pandemics or public-health emergencies, governmental restrictions or travel advisories, civil unrest, armed conflict, strikes, acts of terrorism, failures in essential public services, and any other event that an experienced tour operator could not reasonably foresee or avert.
In the event of force majeure, The Good Traveler Colombia shall employ commercially reasonable efforts to, at its election and in consultation with the Traveler: (a) reschedule the affected services at no additional cost, subject to availability; (b) substitute services of equivalent quality; or (c) refund the recoverable portion of payments made, after deduction of non-recoverable third-party costs already incurred on the Traveler’s behalf.
14. Consumer Rights and Right of Withdrawal (Ley 1480 de 2011)
The contractual relationship between the Traveler and The Good Traveler Colombia is governed by the Colombian Consumer Statute (Ley 1480 de 2011).
For bookings made remotely through this website, the Traveler shall have the right of withdrawal (derecho de retracto) pursuant to Article 47 of Ley 1480 within five (5) business days following booking confirmation, with full refund of amounts paid. The right of withdrawal shall not apply to services whose execution has commenced within the withdrawal period with the Traveler’s express consent, nor to services scheduled for specific dates where rendering becomes impossible due to such date constraint (Article 47, paragraph 1).
To exercise the right of withdrawal, the Traveler shall send written notice to raul.rodriguez@elbuenviajero.com within the indicated term. The Company shall confirm receipt and shall process the refund within fifteen (15) business days.
Beyond the right of withdrawal, cancellations shall be governed by the Cancellation and Booking Policy. For any consumer complaint not resolved directly with the Company, the Traveler may also file a claim before the Superintendencia de Industria y Comercio (SIC).
15. Governing Law and Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Colombia. Any dispute arising from or related to the use of this website shall be subject to the exclusive jurisdiction of the courts of Bogotá, Colombia.
